California Assembly Bill (AB) 1276
AB 1276 (2022) requires that all retail food facilities and food delivery services provide single-use foodware accessories and condiments only upon request. Specifically:
-
Single-use foodware items cannot be bundled together.
-
Single-use foodware accessories and condiments can only be provided upon request, except at drive-throughs and airports, where staff can ask if a customer wants single-use foodware accessories.
-
Third-party food delivery platforms being used by food facilities must list the availability of single-use foodware accessories on their menu and only provide those items when requested.
Businesses can comply by:
-
Informing staff that items must be requested, not provided automatically.
-
Posting signage to let customers know they can request what they need.
-
Eliminating bundled single-use items.
-
Allowing self-serve stations with items not bundled or wrapped so customers may take only what they need. Consider providing bulk dispensers for condiments.
-
Updating online ordering menus to allow consumers to request each available accessory or condiment.
