The form may be printed, filled out, and mailed or delivered to the City.
FILM PERMIT TERMS AND CONDITIONS
GENERAL INFORMATION: The Film Permit is issued by the Film Development Officer for the purpose of filming on City-owned, leased or controlled real property and/or City streets. The Film Permit does not constitute or grant permission to use or occupy property not owned, leased or controlled by the City of Santa Maria. The Film Permit must be in the possession of the Permittee at all times while on location and is not transferable.
PERMIT COORDINATION: The Film Development Officer will secure the necessary permits and clearances from required City Departments. Permittee shall advise of any filming that necessitates street closures, partial street blockage, halting of traffic or obstruction of sidewalks due to the encroachment of equipment, work crews or vehicles.
NOTE: Broadway Avenue (Highway 135) and Main Street (Highway 166) are State Highways and not within the jurisdiction of the City of Santa Maria. Accordingly, it is up to Permittee to obtain any necessary encroachment permit from CalTrans for filming on these thoroughfares and to coordinate any required approvals from utility companies, if applicable.
TIME RESTRICTIONS: In residential areas, filming is restricted to the hours of 7:00 AM to 10:00 PM. Night filming must be approved in writing in advance by the Film Development Officer.
NOTICE PRIOR TO ENTRY: Permittee shall provide at least twenty-four hours notice to the Film Development Officer prior to entry by any of its officers, agents, employees, contractors or subcontractors upon City property for purposes of filming.
All residents and/or businesses within a three hundred foot radius of filming locations must receive at least forty-eight hours advance written notification of the filming activity. Such notice shall include, but not be limited to: film company name, phone number, contact person, length of time filming will occur, and notification if any public streets or access ways will be blocked or obstructed.
PARKING: All production vehicles must be marked with visible identification at all times while on location for parking enforcement purposes. Permittee shall advise of any additional parking requirements so that the Film Development Officer can arrange for adequate parking.
PYROTECHNICS: Permittee shall advise of any special effect or stunt where pyrotechnics or any other material deemed hazardous is to be used, including, but not limited to, fireworks, open flames, and explosives.
ACKNOWLEDGMENT: The City of Santa Maria would like to be acknowledged in film credits for any assistance provided in making feature films, television movies or documentaries. Neither the City of Santa Maria nor any City insignia shall be mentioned as a real location or used in the script unless authorized in writing by the Film Development Officer.
EQUAL EMPLOYMENT OPPORTUNITY: Permittee shall take affirmative action to insure that it not discriminate against any employee or applicant for employment because of race, color, religion, ancestry, gender, age, national origin or physical handicap. Permittee shall make a good faith attempt to employ Santa Maria residents and/or use Santa Maria-based services and accommodations while filming here.
COMPLIANCE WITH ALL PERTINENT LAWS: Permittee shall comply with all City ordinances and state and federal laws.
ALTERNATIONS AND/OR CHANGES TO CITY PROPERTY: Permittee shall not alter, modify or otherwise change any City property without prior written approval of the Film Development Officer. Permittee will, at its own expense, remove any alterations or modifications that it makes to City property and return the property to its original condition, reasonable wear and tear expected, upon the expiration of the permit.
FEES: Permittee shall pay the City's costs for providing services when required while filming on City-owned property. A schedule of actual hourly fees for services is available upon request from the Film Development Officer. All fees for City services performed in relation to the film permit shall be due and payable within ten (10) working days after Permittee receives an invoice from the City for such services.
FILM PERMIT INSURANCE REQUIREMENTS
Permittee shall procure and maintain for the duration of the filming activity insurance against claims for injuries to persons or damages to property which may arise from or in connection with the filming activity permitted hereby by the Permittee, his agents, representatives, employees or subcontractors.
MINIMUM SCOPE OF INSURANCE: Coverage shall be at least as broad as:
- Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001).
- Insurance Services Office Business Auto Coverage Form Number CA 0001, Code 1 (any auto).
- Workers' Compensation Insurance as required by the State of California and Employer's Liability Insurance.
MINIMUM LIMITS OF INSURANCE: Permittee shall maintain limits no less than:
- General Liability: $1,000,000 per occurrence for bodily injury, personal injury and property damage. If Commercial General Liability Insurance or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required occurrence limit.
- Automobile Liability: In compliance with California Department of Motor Vehicles requirements.
- Workers' Compensation Insurance and Employer's Liability: $1,000,000 per accident for bodily injury or disease.
Each insurance policy required by these clauses shall be endorsed to state that coverage shall not be canceled by either party, except after thirty (30) days' written notice by certified mail, return receipt requested, has been given to the City.
DEDUCTIBLES AND SELF-INSURES RETENTIONS: Any deductibles or self-insured retentions must be declared to and approved by the Film Development Officer. At the option of the City, either: the insured shall reduce or eliminate such deductibles or self-insured retentions with respect to the City, its trustees, officers, employees and volunteers; or the Permittee shall provide a financial guarantee satisfactory to the City, guaranteeing payment of losses and related investigations, claim administration and defense expenses.
AUTOMOBILE INSURANCE PROVISIONS: Liability insurance certificates shall be endorsed to contain the following listed as additional insureds: The City, its trustees, officers, employees and volunteers. All vehicles, trailers or transport equipment must carry liability insurance with provisions equal to or greater than the amounts as defined by the State of California Department of Motor Vehicles.
ACCEPTABILITY OF INSURERS: Insurance is to be placed with insurers with a current AM Best's rating of no less than A:VII.
