Santa Maria residents may request the issuance of an administrative citation for the possession, manufacture, storing, selling, handling, or usage of illegal fireworks through the third-party administrative citation process. Requests must meet the evidentiary requirements of Santa Maria Municipal Code Section 1-9.03(a). The request must include statements detailing the address where the violation occurred, the person or persons allegedly responsible for the violation, and the details of the violation, among other information required to establish a violation as determined by staff. Reportable violations include those listed in Title 6, Chapter 6-14 of the Santa Maria Municipal Code.
Incomplete forms will not receive follow-up
All witnesses are requested to submit documentary evidence, even when not formally required by Santa Maria Municipal Code Section 1-9.03(a). Evidence must be in the form of photos and/or video of the alleged violation. Evidence may be submitted in the form of printed photos, digital images (JPEG or PNG), or video (.mp3 or .mp4 or .wmv). Evidence may be turned over on a DVD, thumb drive, or be uploaded to City Dropbox account, or a City email account. Once you submit the form, the City will provide you with a reference number and the Dropbox link, or the City email account, at that time.
Electronic submission of evidence is encouraged. Physical copies may be submitted to: Fireworks Violations, City Attorney’s Office, City of Santa Maria, 204 E. Cook Street, Santa Maria, California, 93454. Physical submissions must include the third-party administrative citation reference number which you were provided after filing out the form.
Additional information may be requested of you once your initial request has been reviewed by staff. The individual who submits this form is required to sign an affidavit under the penalty of perjury verifying that they personally observed a violation of the City Code and attesting to the truthfulness of their statements. The individual must indicate that he/she will make him/herself available to testify at any future hearing on the administrative citation.
